General Terms and Conditions for Contracting and Using Urban Lockers

PURPOSE

These general terms and conditions govern the contracting of Urban Lockers lockers (owned by URBAN LOCKERS S.L) through the website www.urban-lockers.com (the “Website”) as well as their use. Likewise, these terms and conditions regulate the contractual relationship between URBAN LOCKERS S.L (owner of Urban Lockers lockers) and the User who contracts the Urban Lockers locker service. Hereinafter, URBAN LOCKERS S.L will be referred to interchangeably as URBAN LOCKERS S.L or Urban Lockers.

THE SERVICE

Urban Lockers offers its Users the possibility of renting any of its lockers for periods of calendar days (within the hours offered by Urban Lockers).

Users may store their luggage and belongings at Urban Lockers facilities, exclusively within the reserved locker(s), during the contracted reservation period.

Once the booking process is complete, Users will receive a booking confirmation code, which will allow them to find out the assigned locker number, the duration of the booking, and the code or access key for the locker, in accordance with the terms indicated in the section on access and booking.

What kind of lockers does Urban Lockers offer?

Urban Lockers offers two types of lockers:

  • S: 12 cm high x 30 cm wide x 40 cm deep. Small items such as keys, documents, TV/air conditioning remote controls, etc.
  • L: 37cm high x 48cm wide x 58cm deep. 1 carry-on bag + 1 small backpack.
  • XL: 47 cm high, 48 cm wide, 58 cm deep. 2 carry-on bags
  • XXL: 85 cm high x 48 cm wide x 58 cm deep. 1 large suitcase or 4 carry-on bags.

What can a user put inside their locker?

Within the limits established in this document (see Section Limits on the use of lockers), a User may store as many items as they wish, within the specified measurements, so as not to overload the locker.

How can a user know if there are any free Urban Lockers available?

Through the website www.urban-lockers.com, users can check the availability of lockers for the days they want.

How long can you rent the same locker?

The User may contract the locker rental service for a minimum period of 1 day.

When will the User be able to access the locker or lockers they have rented?

The locker rental service will be available to users 24 hours a day, every day of the week.

Therefore, any User who rents a locker for one day may access it from 7:00 a.m. on the date on which the reservation begins and must remove their belongings before 6:59 a.m. the following day. Once the contracted reservation period has elapsed, Urban Lockers will be authorized to open the locker and remove the belongings. Under no circumstances will Urban Lockers open any belongings or access their contents.

It is the User’s responsibility to store their belongings properly packed and not to leave any loose items behind.

The removed belongings will be stored on the premises for a period of 48 hours, during which time they may be claimed by the User. Once this period has elapsed, the belongings will be presumed abandoned for all purposes, and Urban Lockers will assume no responsibility for them and will be free to dispose of them, without the customer having any right to make a claim against Urban Lockers.

Once the User has inserted the packages, can they only access the locker again to remove them?

No, the Urban Lockers service is a locker rental service. The User may access the rented locker as many times as they wish or need during the rental period of the locker(s). Therefore, if the User has forgotten something or needs to access their locker throughout the day, they can do so without any problems during the period they have reserved with the access code generated and notified to them when making the reservation.

What is the price that the User must pay per type of daily deposit?

The price per item will be that indicated on the Website at the time of booking, and the User may benefit from any offers in force at that time.

The prices listed on the Website include VAT and refer to the rental of a locker (depending on its size) per calendar day.

How are slogans used?

The lockers offered through Urban Lockers are fully automated. Users can make reservations through our website www.urban-lockers.com, indicating, in addition to their personal details, the number of lockers they wish to rent, their size, and the reservation period. Once the reservation is complete, the User will receive confirmation of the reservation, the number of lockers reserved, and their security code to access their locker(s).

Therefore, the User will access their locker using the security code provided by URBAN LOCKERS S.L. when making their reservation.

What can the User do if they encounter any type of incident when using the locker?

In the event of a malfunction, blockage, or any other type of incident in the use of the locker, the User will have access to Urban Lockers’ customer service, which can be reached by calling +34660621020 or by writing to the following address: info@urban-lockers.com.

Can the User modify or cancel their reservation?

Yes, provided that such modification or cancellation is made 24 hours prior to the date on which the service I have booked begins.

To cancel a confirmed reservation, the User must contact Urban Lockers by calling +34660621020 or by writing to the following address: info@urban-lockers.com.

The refund, if applicable, will be made within a maximum period of 20 days from the time of cancellation, provided that the User has made the cancellation 24 hours prior to the scheduled start date.*.*

Failure by either party to comply with its obligations under these General Terms and Conditions shall entitle the non-breaching party to terminate the reservation by simply notifying the breaching party in writing. The consequences of early termination of the reservation due to breach by one of the parties shall be as follows:

  • In the event of non-compliance by a User, the reservation will be terminated, their belongings may be removed if the User does not do so within 2 hours of being requested to do so, and they will not be entitled to a refund of the price paid for the reservation. In the event of damage to the establishment, the facilities, or the property of other users, the User will be liable for the damages caused.
  • In the event of non-compliance by the Company, it undertakes to refund the User the amount paid online for the reservation.

ACCESS AND RESERVATIONS

Urban Lockers will make every effort to offer the Website in optimal conditions for use 24 hours a day and to guarantee, as far as reasonably possible, the security of the Website.

Notwithstanding the foregoing, Urban Lockers shall not be liable, under any circumstances, for any malfunction, temporary interruption of the Website, or loss of content attributable to third parties or any unforeseeable event beyond Urban Lockers’ control, such as acts of God or force majeure.

Urban Lockers reserves the right to temporarily interrupt access to the Website if necessary to carry out maintenance work for as long as necessary, making every effort to ensure that the interruption is as short as possible and has the least impact on Users.

In order to rent Urban Lockers, the following requirements must be met:

  • Be at least 16 years old.
  • Fill in the fields indicated on the form in the RESERVATIONS section of the Website truthfully and accurately (in particular, the following: first and last name, telephone number, email address, reservation date, rental days, number of lockers you wish to rent (indicating the size), information necessary to complete the payment, depending on the payment method used).
  • Accept these general terms and conditions for contracting the service and using the lockers.
  • Accept the privacy policy of URBAN LOCKERS S.L., as the owner of Urban Lockers lockers.

Once the booking process is complete, the User will receive confirmation of their reservation by email and SMS. This confirmation will indicate the number or numbers of lockers assigned to the User, the day or days reserved, and the access code or codes for the locker or lockers.

Urban Lockers reserves the right to limit, relocate, or cancel the reservation in the event of possible mechanical or electrical breakdowns and/or general maintenance, without the User being entitled to claim any compensation in such cases.

If the User detects any incident or malfunction when opening their locker at the time of retrieving their belongings, they shall immediately notify Urban Lockers by calling the following telephone number: +34660821020. For its part, Urban Lockers undertakes to resolve the incident within a maximum period of two hours, and it is the user’s responsibility to arrive with sufficient time in advance to retrieve their belongings.

If the incident is not resolved within this period, Urban Lockers will cover the cost of shipping the belongings to the address indicated by the User, provided that the User has had to travel without their belongings due to the malfunction. The User will not be entitled to claim any other damages.

The form referred to in the previous section, which must be completed by the User, contains the information that URBAN LOCKERS S.L. needs to formalize the rental of Urban Lockers lockers by the User, as well as to comply with the contractual obligations that will arise for the parties to the locker service that the User, where applicable, contracts.

The User guarantees that all information provided regarding their identity and the reservation is true, accurate, and complete.

The personal data provided will be used to manage the reservation and comply with the obligations arising for the parties to the locker service. URBAN LOCKERS S.L. is entitled to process the personal data provided by the User during the contracting process, as it is necessary for the provision of the service. By contracting the service, the User expressly consents to the processing of their personal data in accordance with the terms detailed herein.

On the other hand, URBAN LOCKERS S.L will use the personal data of Users of the lockers and, in particular, their email address to send them commercial communications by email about the services offered by URBAN LOCKERS S.L and its commercial offers. If you do not wish to receive commercial communications from URBAN LOCKERS S.L by email, you must check the corresponding box during the contracting process. If, on the other hand, you agree to receive commercial communications by email, URBAN LOCKERS S.L informs you that this consent may be revoked at any time.

Furthermore, Users are informed that there are video surveillance cameras in Urban Lockers premises. The purpose of these cameras is to monitor the condition of the lockers at all times, as well as the use made of them by Users or third parties who access the premises, with the aim of providing a better service on the part of URBAN LOCKERS S.L. All Urban Lockers premises include the corresponding notices regarding the video surveillance area in accordance with the provisions of current data protection regulations.

Users may exercise their rights of access, opposition, limitation, rectification, and cancellation of their data at any time by sending a written request identifying themselves (to which they must attach a copy of their ID card/foreign resident ID card or passport) to: Calle Aribau, 50, 5-1, 08011 Barcelona, Spain, or to gestion@urban-lockers.com. If the User, at any time, considers that URBAN LOCKERS S.L. has infringed the applicable data protection regulations, they will be entitled to file a complaint with the Data Protection Supervisory Authorities and, in particular, with the Spanish Data Protection Agency.

URBAN LOCKERS S.L does not carry out international data transfers or make automated decisions based on the information provided by the User.

URBAN LOCKERS S.L will retain the User’s personal data for as long as necessary to provide the service, as well as for the period necessary for URBAN LOCKERS S.L to comply with its legal obligations. After this period, your data will be deleted. On the other hand, in any case, URBAN LOCKERS S.L will retain your data to the extent that your consent to receive commercial communications by email has not been revoked, if you have given it.

USER OBLIGATIONS. LIMITS ON THE USE OF LOCKERS

By contracting the services of Urban Lockers, the User agrees, in particular and without limitation, to:

  1. To use exclusively the reserved lockers and for the sole purpose of storing goods belonging to you that you need to keep temporarily in a safe place.
  2. Do not use or deposit luggage in a free luggage storage facility without having made the corresponding reservation or without having ensured that it is the assigned storage facility confirmed through the reservation code.
  3. Please check the size of your luggage before making your reservation to avoid overloading the luggage compartment. No claims or refund requests will be accepted if your luggage exceeds the dimensions of the luggage compartment.
  4. Under no circumstances is it permitted to overload the locker or deposit items outside the designated space reserved for that purpose. It is strictly prohibited to deposit luggage in an unreserved locker without having made a reservation or without having ensured that it is the assigned locker and as such confirmed and notified at the time of making the reservation.
  5. To use the lockers diligently. In particular, and without limitation, the User undertakes not to overload the locker and to ensure that the locker has been properly closed when the User leaves the premises (after inserting or removing the packages).
  6. To notify Urban Lockers immediately of any damage or abnormal situation in relation to the lockers by calling the following telephone number: +34660621020. By way of example, an abnormal situation shall be considered to be when the locker reserved by the User is occupied with belongings or objects belonging to another user, in which case the User shall be obliged not to remove the forgotten belongings. Failure to comply with the obligations set forth in this section will result in a penalty for the User of up to 500 euros.
  7. Not to use locker for illegal or unauthorized purposes. In particular, the User agrees not to store items whose mere possession or trafficking is illegal (such as stolen goods, drugs, pornographic materials, or anything that is degrading to human beings, etc.).
  8. Please deposit your belongings properly packaged.
  9. Not to deposit any goods whose possession requires a license without such license or authorization (such as weapons).
  10. Do not place any type of material that is polluting or dangerous (such as flammable objects or hazardous substances) in the lockers.
  11. Do not use lockers to store animals or any other living creatures.
  12. Do not place food in the lockers, unless it is packaged food that cannot spill, stain the lockers, or produce odors of any kind in the Urban Lockers premises.
  13. Not to disclose your security code to any third party, being fully responsible for any breach of this obligation and its consequences.
  14. Do not use lockers to store goods that are to be collected by a third party. Lockers should not be used as a means of transporting goods between parties. This use is not authorized by URBAN LOCKERS S.L.
  15. To access the premises and remain there for the sole purpose of accessing the rented locker and only to carry out a specific action in relation to the items stored therein. The User may not remain on the premises for longer than is strictly necessary.
  16. No eating or drinking inside the premises.
  17. Please remove any items stored in the rented lockers before 6:59 a.m. on the day your rental period ends.
  18. To leave the lockers, at the end of the service, in the same condition in which they were found and, in particular, to notify Urban Lockers via gestion@urban-lockers.com of any incident that the User encounters in the use of the lockers or in their condition.
  19. Not to take photographs or videos inside Urban Lockers premises and, in particular and without limitation, not to take photographs or recordings of the security mechanisms of the premises.
  20. Do not leave valuables in the lockers, such as money, jewelry, technological devices (tablets, computers, televisions, etc.) or any documents you may need for identification or travel (such as identity documents or tickets). To this end, the User undertakes to take all necessary precautions and measures to ensure that they have not left any documents necessary for the trip or any other valuable items in the luggage locker.

URBAN LOCKERS S.L. shall not be liable, under any circumstances, for the loss of flights, trains, or any other tickets for the User’s travel that occur as a result of depositing tickets or identification documents in the locker(s). URBAN LOCKERS S.L. shall also not be liable for the loss of any item whose unit value exceeds 400 euros. Consequently, it shall be the sole responsibility of the User to deposit such documents and goods of special value or necessity in the rented lockers, contrary to the provisions of these General Conditions.

CONSEQUENCES AND RESPONSIBILITY OF THE USER IN CASE OF BREACH OF THEIR OBLIGATIONS

The User shall hold URBAN LOCKERS S.L harmless for any damages arising from the breach of their obligations under this contract.

Failure to comply with the rental period

In particular, if the User does not empty the rented locker(s) on or before the rental expiration date, URBAN LOCKERS S.L. shall be authorized to access the lockers to remove the stored items, in order to free them up for normal use by URBAN LOCKERS S.L. customers. If necessary, URBAN LOCKERS S.L. will temporarily store the items and attempt to contact the User who has failed to comply with the rental period in order to arrange for the return of the items to the User (the cost of which will be borne 100% by the User). If, after 48 hours, it has not been possible to contact the User or the User has not contacted URBAN LOCKERS S.L. and it has not been possible to deliver the packages to them, it will be understood that the goods have been abandoned by the User for all purposes. In this case, URBAN LOCKERS S.L. will cease to store them, disposing of them as it deems appropriate or convenient, depending on the type of abandoned goods.

For each day that passes from the expiration of the rental period without the User having released the item(s) in storage, until their delivery to the User or collection by the User, an amount equivalent to the price of the uncollected item in storage will be charged per day. In addition, a penalty of €150 will be charged, which the User must pay to URBAN LOCKERS S.L., regardless of URBAN LOCKERS S.L.’s right to claim damages actually suffered.

Unless the User personally collects the packages, URBAN LOCKERS S.L will manage the shipment of the packages to the User, subject to payment of the service to URBAN LOCKERS S.L by the User. In particular, where applicable, the User must pay URBAN LOCKERS S.L. €25 per package if the shipment is to be made within Spain and €50 per package if the shipment is to be made outside Spain. Delivery shall be deemed to have taken place from the moment URBAN LOCKERS S.L. hands over the packages to the carrier, with URBAN LOCKERS S.L. assuming no risk for the transport of the packages.

The refund will be made once URBAN LOCKERS S.L has received payment from the User for the amounts accrued for the delivery of the goods (according to the number of packages and the destination) in accordance with the provisions of the previous paragraph. If, after 10 calendar days from the date on which URBAN LOCKERS S.L has communicated in writing the amount to be paid, the User has not made the payment, it will be understood that the packages have been abandoned for all purposes by the User, and URBAN LOCKERS S.L will proceed in accordance with the terms specified above for abandoned goods.

Failure to comply with the proper use of lockers

URBAN LOCKERS S.L reserves the right to remove any item that does not comply with the rules of use of the lockers and is a prohibited item. In such cases, URBAN LOCKERS S.L will be authorized to call the police and report the conduct, as well as to remove the prohibited items.

The User shall be responsible for the items they place in the lockers.

In any case, the removal of prohibited items will result in a penalty of €150, which does not exclude the non-compliant User’s obligation to compensate URBAN LOCKERS S.L. for any damages actually caused.

Damage caused to lockers by Users

The User shall be fully liable for any damage or deterioration caused to the lockers due to their improper or inappropriate use. The User shall be liable for any damage or deterioration caused to the lockers and to other people’s luggage in the event of storing prohibited or dangerous items, poorly packaged items, or through the improper use of the lockers. If necessary, the User must compensate URBAN LOCKERS S.L. for any physical damage caused to the locker(s), the facilities, or the goods stored in other lockers, as well as for any loss of profits.

In particular and without limitation, the User causing the damage must pay URBAN LOCKERS S.L. a penalty equal to the daily rental fee for each day that the locker is unusable, as well as the cost of repair or replacement, which is quantified at €1,000 in the event of replacement, regardless of the damages caused.

Payment of penalties

The penalties detailed in this section shall be paid by the User using the same payment method used by the User when contracting the service or by bank transfer to the account indicated by URBAN LOCKERS S.L. if requested by the User. The User expressly agrees that URBAN LOCKERS S.L. may collect the amounts established in this section using the User’s card or payment method used when contracting the service.

URBAN LOCKERS’S OBLIGATIONS

Urban Lockers undertakes to maintain the locker service active and to make available to the User, during the contracted period, the locker or lockers contracted by the User in good working order.

Furthermore, Urban Lockers undertakes to resolve any incident that may arise in the use of the lockers as quickly as possible. In the event of any incident, in order to safeguard the items deposited, Urban Lockers reserves the right to move the deposited goods to the warehouse or another locker.

LIMITATION OF LIABILITY OF URBAN LOCKERS S.L.

URBAN LOCKERS S.L offers a locker rental service and is not responsible for the safekeeping of items. The User is solely responsible for the items placed in the rented lockers.

The liability of URBAN LOCKERS S.L. is limited to the duration of the locker rental period. Consequently, URBAN LOCKERS S.L. shall in no case be liable for any damage or loss that may be suffered by the User’s belongings outside the duration of the contracted reservation period.

Notwithstanding the foregoing, in the event of theft, URBAN LOCKERS S.L. has taken out an insurance policy on behalf of Users that covers losses due to theft up to a maximum of €250 per locker.

This insurance does not cover the loss of money, jewelry, precious stones or metals, watches, plasma screens, and technological devices in general (LCDs, GPS navigators, mobile phones, computers*, tablets*), works of art, antiques, memory cards, or any other medium containing data or images.

COMPLAINTS

If the User considers that they have grounds for filing a complaint, they may do so by sending an email to the following address: gestion@urban-lockers.com.

URBAN LOCKERS S.L. will attempt to resolve the incident and find a satisfactory solution for all parties involved.

If the User is not satisfied with the response from URBAN LOCKERS S.L., they have the option of submitting a complaint form to the consumer authorities of the Community of Madrid. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by Spanish law. The parties submit to Spanish jurisdiction to resolve any dispute arising in connection with this Agreement.
